PRESS RELEASE: THE DEPORTATION OF 4 TURKISH REFUGEES BY THE KENYAN GOVERNMENT IS A VIOLATION OF BOTH THE CONSTITUTION OF KENYA AND INTERNATIONAL LAW.

The Principle of non-refoulment, at Art 33 of the 1951 Refugee Convention, which requires that refugees should not be returned to a country where they face serious threats to their life and Freedom is the CORNERSTONE of the 1951 Convention on Refugees. Kenya has cited bilateral agreements between her and Turkey as the reason for the forceful repatriation. Bilateral agreements between two countries cannot be invoked to supersede the provisions of international law. Besides, a repatriation argument would only be invoked under circumstances where the refugees yield to it voluntarily.
