The United Green Movement Party together with 9 other organizations including Ukweli Party, the Communist Party of Kenya, Siasa Place and the Kenya Human Rights Commission have today, on #NaneNane petitioned the Chief Justice Marth Koome to assign 5 judges of the High Court to deliver judgement that the President dissolves the 13th Parliament.
Art 261 (7) of the CoK clearly states that ‘If Parliament fails to enact legislation in accordance with an order under clause (6) (b), the Chief Justice SHALL advise the President to DISSOLVE Parliament, and the President SHALL DISSOLVE Parliament.’
Article 27(8) of the CoK states that the State shall take steps to ensure that not more than two-thirds of members of all elective & appointive positions are not of the same gender. Ten years after the promulgation of the Constitution of Kenya 2010, this parliament has failed to enact legislation to operationalize this provision for the 2/3 gender rule and is therefore unconstitutional.
The former CJ David Maraga advised the president to dissolve the parliament in 2019. We are calling on the CJ Martha Koome to assign 5 judges of the High Court to similarly deliver judgement that the President dissolves the 13th Parliament.
